Terms of Use
These terms add game rules to Apple's standard licence for apps. By downloading or using HLOD!!, you agree to them.
In short
HLOD!! is a game. The points are not money. Nothing in it is advice. You must be 16 or older. Be fair and do not cheat. If you live in the EU or UK, you keep your local consumer rights.
1. Who we are
HLOD!! is made by an independent developer ("we", "us"). You can reach us at HLODsupport@icloud.com. The developer is the seller named on HLOD!!'s App Store and TestFlight page.
You must be at least 16 years old to use HLOD!!. If you are under 16, please do not use the app.
2. A game, not advice
HLOD!! is entertainment. The prices, characters, outcomes and scores in the game are simulated for play. Nothing in HLOD!! is financial, investment, trading, legal or medical advice, and a good score does not predict anything about real markets. Do not make real-world decisions based on the game.
No real money
HLOD!! uses virtual points only. You cannot put real money in, take real money out, or receive prizes.
3. Virtual points
Points are part of the game. They are worth nothing outside it. You cannot buy, sell, give away or swap them for money or anything else. We may reset, change or remove them.
4. Your licence
We give you a personal licence to use the app on Apple devices you own or control. You cannot pass it on to others, and we can end it. It follows these terms and Apple's standard app licence (the "Apple EULA"), at apple.com/legal/internet-services/itunes/dev/stdeula. If these terms and the Apple EULA conflict, the Apple EULA controls for the licence and these terms control for everything else.
5. Acceptable use
Please do not:
- copy, resell, rent, or extract assets or code from the app, or reverse engineer it except where the law allows;
- use bots, scripts or cheats, or tamper with the app, its records or the services it uses;
- send us other people's personal details, unlawful content or anything harmful in surveys or feedback;
- use the app in any way that breaks the law.
6. Headlines and third-party content
The game shows real headlines from public sources next to made-up headlines and characters. Real headlines come from third parties and are shown as they were published, without our endorsement. They may be delayed, incomplete, inaccurate, or about distressing events such as accidents, disasters, conflict or crime. We do not control or guarantee them.
The names of organizations, agencies and publications that appear belong to their owners. Their appearance does not mean they sponsor, endorse or are connected to HLOD!!. The made-up characters and made-up news are fiction.
7. Your feedback
If you send feedback or survey answers, you let us use them to improve the game without owing you anything. You remain responsible for what you write. HLOD!! does not show your text to other players.
8. Privacy
Our Privacy Policy explains what the game handles and your choices. It forms part of these terms for that subject.
9. Our rights
The app, its design, text, art, sounds and code belong to us or our licensors and are protected by law. These terms do not give you ownership of any of it, and you may not use the HLOD!! name or look for any other purpose without our written permission.
10. Disclaimers
As far as the law allows, HLOD!! is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, availability or that it will be error-free. Some places do not allow some of these limits, so they may not apply to you.
11. Limit of liability
As far as the law allows, we are not liable for indirect or knock-on losses, or for lost data, profits or chances, that come from using HLOD!!. Our total liability for any claim about the app is the amount you paid for it, or US$50 if that is more. This cap and the other limits here do not limit anything the law does not let us limit. That includes death or personal injury, fraud, and your rights under data protection law. If you are a consumer in the EU or UK, you keep the consumer rights you have where you live. Nothing here takes them away.
12. Changes
We may update the app and these terms. When we change the terms, we will update this page and its date. For a big change, we will tell you in the app before it applies to you. You can then choose: accept the change, or stop using the app and delete it. A change will not take away rights you cannot lose under the law.
13. Ending your use
You can stop using HLOD!! by deleting the app. We may suspend or end your access if you break these terms or if the law says we must. We may also end the game. Some parts continue after your use ends, such as disclaimers, limits of liability and governing law.
14. Governing law
These terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-law rules. Courts located in Florida have jurisdiction over disputes, except that nothing here removes the consumer protections or court rights you have by law where you live. If you are a consumer, you may also bring a claim in the courts where you live.
15. Apple
These terms are between you and us, not Apple. Apple is not responsible for the app or its content, maintenance, support or any claims about it, and Apple and its subsidiaries are third-party beneficiaries of the Apple EULA as set out in it.
